The Court of Talca condemns the Municipality of San Javier for arbitrary and illegal actions against Coexca S.A.
Acknowledging compliance with environmental and municipal regulations, the Talca Court of Appeals accepted the protection appeal filed by Agrícola Coexca S.A. against the Director of Works of the Municipality of San Javier, Mario Navarro, and the municipality itself, represented by Mayor Jorge Silva. The court ordered them to annul their administrative decisions regarding the final reception permits for the San Agustín del Arbolillo pig farming center located in that municipality. The court's decision was influenced by the lack of due process, noting that Agrícola Coexca S.A. was not allowed to present evidence or defenses against the accusation, as required by law. The company had requested information on the alleged illegalities in the construction receptions and asked for a 20-business-day period to present its arguments, which was not granted by the opposing party. "It is possible to conclude that the contested acts are arbitrary, as they do not contain all the reasons for the decision made, and illegal, for violating the norms of due process and the right to defense," states the Talca Court of Appeals' ruling. Guillermo García, General Manager of Agrícola Coexca S.A., stated that "to annul or even question these permits, not only lacks foundation but is also a completely illegal measure against a well-awarded reception."
