Despite the efforts of the National Human Rights Institute to sway public opinion, the country's highest court dismissed the arguments presented by the INDH against the company regarding the operation of its pig farm "San Agustín del Arbolillo" in San Javier. Consequently, the verdict confirms that the company possesses an Environmental Qualification Resolution and all the necessary legal permits to run the pig farm. It also states that the farm's operations do not harm the health, physical, or psychological well-being of the local population, as determined by the Talca Court of Appeals. It is worth noting that the INDH and the mentioned family appealed to the country's supreme court, expressing their dissatisfaction with the decision made by the Talca Court of Appeals. In February, the court dismissed their claims in a protection lawsuit and only required the company to comply with the Environmental Qualification Resolution No. 165 of 2018, which it indeed does, maintaining the highest standards. Therefore, the appeal filed by the INDH to the supreme court was not accepted. With its decision, the Supreme Court upheld the verdict of the Maulino appellate court, effectively allowing the "San Agustín del Arbolillo" pig farming center to continue its operations without interruption, as it has since its opening in 2017, adhering to all legal and environmental regulations. Thus, the Supreme Court's ruling reaffirms that the farm has an Environmental Qualification Resolution (RCA 165/2008) and validates all permits for its operation, in compliance with the laws and regulations governing the activity.
